Preamble

The ANTIQUITES SAINT JEAN website is the property of SARL ANTIQUITES SAINT JEAN in its entirety, as well as all related rights. Any reproduction in whole or in part is systematically subjected to the authorization of the owners.

The general conditions of sale are intended to frame the sale between the ANTIQUITES SAINT JEAN site and the customer.

Acceptance of the General Terms and Conditions of Sale

The customer acknowledges having read the general terms and conditions of sale at the time of placing the order, and declares to accept them without reservation.

These General Conditions of Sale govern the contractual relations between ANTIQUITES SAINT JEAN and its customer, both parties accepting them without reservation.

Orders

Automatic recording systems shall be considered as proof of the nature, content and date of the order.
ANTIQUITES SAINT JEAN will confirm the acceptance of the order to the customer at the e-mail address he will have given, the sale will then be said to be concluded.

ANTIQUITES SAINT JEAN reserves the right to cancel any order from a customer with whom there is a dispute concerning the payment of a previous order, or any order of an abnormal nature, in particular with aberrant quantities.
The information given and entered by the buyer on the ANTIQUITES SAINT JEAN site, when taking an order, is binding in the event of an error in the wording of the recipient's details, the seller cannot then be held responsible for the impossibility in which he may find himself of delivering the order.

ANTIQUITES SAINT JEAN undertakes to honour orders received only within the limits of available stocks. In the absence of availability, ANTIQUITES SAINT JEAN will inform the customer as soon as possible, indicating the delivery time.
On request of the customer, the order can be cancelled up to the amount of the missing products with a refund by cheque within 21 to 30 days.

Products

The photographs illustrating the products are the property of SARL ANTIQUITES SAINT JEAN and cannot be used by a third party.
These photographs are proposed as an indication and have no contractual character.
The majority of the products offered on ANTIQUITES SAINT JEAN are available on stock.

Any promotion offered on ANTIQUITES SAINT JEAN is valid "while stocks last".
The proposed products are in conformity with the French legislation in force and with the standards applicable in France and in the European Union.
ANTIQUITES SAINT JEAN undertakes not to sell counterfeit products.
The customer undertakes to return within 48 hours from receipt of an alert e-mail, at ANTIQUITES SAINT JEAN's expense, all products that ANTIQUITES SAINT JEAN may ask the customer to return.

If the customer does not respect the procedure, ANTIQUITES SAINT JEAN declines all responsibility for any damage that may occur, and the customer cannot then expect any damages or compensation whatsoever.

The transfer of ownership of the products is expressly subject to full payment of the price. This clause does not prevent the transfer to the buyer, upon delivery of the products, of the risks of loss or deterioration as well as the damages that it could cause.

Awards

The price is expressed in euros.
The price indicated on the "product sheets" does not include transport.
The price indicated in the order confirmation is the final price, expressed all taxes included and including VAT for France and EEC countries. It includes the price of the products, the handling, packaging and conservation costs of the products, the transport and commissioning costs.

Payment

The price invoiced to the customer is the price indicated on the order confirmation sent by ANTIQUITES SAINT JEAN. The price of the products is payable in cash on the day of the effective order.

The order validated by the customer will only be considered effective when the bank payment centres concerned have given their agreement. In case of refusal of the said centres, the order will be automatically cancelled and the customer will be informed by e-mail. In addition, SARL ANTIQUITES SAINT JEAN, reserves the right to refuse any order from a customer with whom there is a dispute.
We do not keep the data relating to the bank cards of our customers following the payment.

Warranty (non-surcharged service)

If, at the time of delivery, the product has defects or is damaged, the customer has a period of 7 days to return the goods in their original packaging without the product having been tampered with or its original packaging having been damaged, for an exchange or refund.

The returned product must be intact, unused, documentation or accessories that accompany it.
As regards food, the consumption dates indicated must be respected by the customer.

Delivery

The preparation of the order and its delivery can only be executed once the order has been paid by the Customer in a certain way. The products are delivered to the delivery address indicated during the ordering process, within the period indicated on the order validation page.

Litigation

The present contract is subject to French law. SARL ANTIQUITES SAINT JEAN, cannot be held responsible for any damages of any kind, be they material, immaterial or corporal, that may result from improper functioning or use of the marketed products. It is the same for possible modifications of the products resulting from the manufacturers.

The responsibility of SARL ANTIQUITES SAINT JEAN will be, in any case, limited to the amount of the order and could not be called into question for simple errors or omissions which could have remained in spite of all the precautions taken in the presentation of the products. In case of difficulties in the application of this contract, the buyer has the possibility, before any legal action, to seek an amicable solution, in particular with the help of: a professional association of the branch, a consumer association or any other advice of his choice. It is recalled that the search for an amicable solution does not interrupt the "short time" of the legal guarantee, nor the duration of the contractual guarantee. It is recalled that as a general rule and subject to the discretion of the Courts, compliance with the provisions of this contract relating to the contractual guarantee assumes that the buyer honors its financial commitments to the seller.

Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in the person who takes the trouble to explain his situation. In the event of a dispute, the customer will first contact the company to obtain an amicable solution.

Attribution of Jurisdiction

Of express convention, between SARL ANTIQUITES SAINT JEAN and the customer who accepts it without reserve nor recourse as soon as he addresses, validates and pays his order to the SARL ANTIQUITES SAINT JEAN: the commercial act of sale is established and carried out at the registered office of the SARL ANTIQUITES SAINT JEAN, 17 rue de Verdun, 69100 VILLEURBANNE, France, the address of the customer being only the place of delivery which can in no case be considered as the place of the commercial transaction.

It follows from the above that only French legislation to the exclusion of any other is applicable to the commercial activity of SARL ANTIQUITES SAINT JEAN.

In the event of a dispute concerning the present general conditions or any acts or situations which would result from it, and in the absence of an amicable solution, when the co-contracting party is not a trader, the plaintiff has the choice in contractual matters between the jurisdictions of Aix en Provence, France or the jurisdiction of the place of effective delivery of the thing.
